The EB-1A classification provides a path to permanent residence for individuals who have demonstrated extraordinary ability in the sciences, arts, education, business, or athletics. The applicant must establish sustained national or international acclaim and recognition demonstrating that the applicant is among the small percentage who have risen to the top of the field. The applicant must also intend to continue working in the area of extraordinary ability in the United States.
A permanent job offer is not required, and an applicant may file without an employer or labor certification. However, the petition must include evidence showing how the applicant intends to continue work in the United States.
EB-1A may be appropriate when:
-
The applicant has a strong record of recognized accomplishments.
-
The evidence demonstrates sustained acclaim beyond a single successful project.
-
Independent experts, organizations, media, or professional institutions have recognized the applicant’s work.
-
The applicant can document achievements satisfying the regulatory criteria.
-
The applicant intends to continue working in the field in the United States.
-
The applicant is seeking permanent residence rather than only temporary work authorization.
Meeting at least three regulatory evidentiary criteria does not automatically establish eligibility. USCIS also evaluates the evidence as a whole to determine whether the applicant has sustained acclaim and belongs to the small percentage at the top of the field.
